SBF（Sam Bankman-Fried），这个美国最年轻的亿万富翁之一，下辈子或将在牢狱中度过。
2022年12月12日下午6点多，SBF在巴哈马群岛的公寓内被巴哈马皇家警察逮捕，预计他将被引渡到美国接受审判。据《纽约时报》援引消息人士称，美国纽约南区法院此前已经以“电信欺诈、电信欺诈共谋、证券欺诈、证券欺诈共谋和洗钱”等罪名起诉SBF。
美国商品期货交易委员会前高级辩护律师布雷登·佩里（Braden Perry）曾向CNBC表示，上述任何一项指控的定罪都可能导致数年或数十年的监禁。
“从理论上讲，在大多数国家，公司经营者单纯的经营管理不善导致客户资金损失或者公司破产的情形在很多情况下不构成犯罪，除非经营者存在严重欺诈，或存在为了自己以及第三者的利益而实行违背委托人利益的行为。”北京大成律师事务所律师王国全向虎嗅表示。
2个月前，SBF还是美国最富有的人之一，92年出生的他曾是全球第二大的加密货币交易所FTX的创始人，该公司的估值一度高达320亿美元，SBF也因此成为亿万富翁。他在2022年10月的净资产还高达105亿美元。然而，百亿美金在短短几天内，烟消云散。
根据彭博亿万富翁指数，2022年11月8日，由于FTX偿付能力不足造成用户恐慌，其净资产在一天内下降了大约94%，至9.915亿美元，这是该指数历史上最大的单日跌幅。而到了2022年11月11日，彭博亿万富翁指数认为SBF的资产已经归零。
SBF被认为是又一个伊丽莎白·霍尔姆斯（Elizabeth Holmes），后者曾是硅谷冉冉升起的科技巨星，她成立了一家高科技血液诊断公司，被称为“女版乔布斯”。然而，最终她被指控“大规模诈骗”用户和投资者，并锒铛入狱，获刑11年3个月。
SBF与伊丽莎白有着相似的经历，他们都求学于名校（麻省理工和斯坦福），30岁前便已通过创立“科技公司”成为亿万富翁，并登上福布斯杂志封面，被美国主流媒体争相报道。两人都获得了科技大佬的支持与帮助，并且与美国政界有着千丝万缕的联系。SBF获得了红杉资本、软银愿景基金、淡马锡等机构的投资；伊丽莎白则获得了德丰杰、ATA Ventures和甲骨文公司创始人拉里·埃里森等的投资。他们的破产，让这些知名投资者们损失惨重，也让全球众多用户遭受欺骗和财产损失。
而这两家公司的创始人也最终因为欺诈行为被曝光，而身败名裂。
此次，SBF被逮捕，是否会被判刑、判决多少年，也成为了美国政治圈、科技圈、加密圈热议的话题。
福克斯新闻节目披露，SBF被指控证券欺诈和洗钱等罪名，这意味着如果指控罪名成立，SBF可能会面临终身监禁。
但是特斯拉创始人马斯克则有不同的观点，他在推特上便表示，SBF不会被调查，因为他是民主党的大金主。据统计，在2022年美国中期选举期间，SBF向美国民主党捐款金额高达3900万美元，是民主党的第二大个人捐款人，仅次于索罗斯。他还宣称通过黑钱渠道向共和党人捐赠了大量资金。在美国政治中，“黑钱”指的是为了影响选举而不向选民公开资金来源的支出，在美国一些非营利组织可能会在不透露捐赠者身份的情况下花钱进行竞选活动。
值得一提的是，FTX的总部最初设立于中国香港，在今年10月底至11月初的香港金融科技周上，SBF还作为重要嘉宾参与。香港在今年10月31日正式发布了《有关香港虚拟资产发展的政策宣言》，吸引了众多加密机构和Web3公司，这无疑也给香港的监管安全带来了一定风险。
“目前香港的虚拟资产交易和Web3从业者应当关注最近刚修订通过的《打击洗钱及恐怖分子资金筹集条例》，该条例明确规定了虚拟资产的含义，经营及涉及虚拟资产的活动的限制等内容，其中明确列明了‘涉及在虚拟资产交易方面使用欺诈或欺骗手段等的罪行’、‘发出关于非持牌人提供虚拟资产业务的广告的罪行’、‘欺诈地或枉顾事实地诱使他人提供虚拟资产的罪行’等刑事罪行。”王国全表示。
FTX事件并非是加密货币行业发生的第一起欺诈事件。一直以来，加密货币和Web3创业公司由于金融投机属性较强，受到了各国监管部门的重点关注，每年都有众多加密货币从业者由于欺诈用户的行为而被各国监管机构实时抓捕。今年9月，韩国法院对加密货币项目Luna的创始人Do Kwon发出逮捕令，据韩国检察官发言人透露，已向包括当时居住在新加坡的Do Kwon在内的六人发出逮捕令。2022年5月，Luna的市值在短短几天内从400亿美元直接归零，超过20万投资者因此遭受损失。
很难说，由FTX所引起的加密货币多米诺骨牌事件会延续多久，还会有多少加密货币公司倒闭，但这一行业在狂欢时期所吸引的资本，正在回归冷静。
